UPSKIRTING victims of a pervert teacher say they have been left “traumatised again” by a sheriff questioning if the images broke sex crime laws.
Brian Smith, 54, admitted taking seedy phone snaps of fellow staff and pupils at two Ayrshire schools in a vile nine-year campaign.



But Sheriff Murdoch McTaggart delayed sentencing him after asking prosecutors if certain photos actually showed genitalia and underwear, and he said he was “struggling to see” how some of the snaps — taken at Stewarton Academy and private school Wellington Academy in Ayr— could be classed as sex crimes.
Some of the English teacher’s victims have now lodged complaints with the Judicial Office of Scotland.
One said what happened at Kilmarnock Sheriff Court was “horrendous”.
The victim added: “It’s like being traumatised and victimised all over again.
“We each had to go through hundreds of images taken up women’s skirts to try to identify which ones were us.
“All of us felt very upset by what happened in court.”
Sheriff McTaggart questioned if tights were underwear and if a pic of a child who had a leg resting on a chair broke the law.
Smith, of Kilmarnock, was caught when a Tesco guard recognised him for previously stalking a woman with a baby.
He will be sentenced this month.
The Judicial Office of Scotland said complaints are “handled in a confidential basis”.
